Special Event - Insurance Information

Whatcom County Parks & Recreation requires all Special Events to be supported by evidence of insurance coverage for the term of the permit. Prior to commencing any of the activities approved by a Special Event Permit, the applicant, at no expense to the County, shall obtain and file with the Department no less than 30 days prior to the event that must meet the minimum requirements. 
The below documents must be submitted 30 days prior to the event. It is helpful to print the linked sample documents for reference.
  1. Certificate of Insurance (CG 00 01 10 01)
  2. Endorsement Form Additional Insured (CG 20 26)
  3. Waiver of Transfer of Rights (CG 24 04)
  4. Primary and Noncontributory (CG 20 01)

***The certificate of insurance along with the supporting policy endorsements for Additional Insured and Waiver of Transfer of Rights must include the following language:

          "Whatcom County, it's dependents, elected and appointed officials, employees, 
           agents and volunteers are named as an additional insured; Whatcom County
           Parks & Recreation Department, 3373 Mt. Baker Highway, Bellingham WA 98226"
The following general guidelines are used to evaluate activities and insurance requirements for Special Events.

All insurance policies (1) shall be subject to approval by the County as to company, form and coverage; (2) shall be primary to and non-contributory with all other insurance and self-insurance maintained by the County and (3) must protect the County from any and all claims and risks in connection with any activity performed by the applicant by virtue of the permit agreement, and any use and occupancy of the premises authorized the permit agreement.  

General Liability: CG 00 01 10 01

  • Premises/Operations Liability
  • Products/Completed Operations
  • Personal/Advertising Injury
  • Contractual Liability
  • Independent Contractors Liability (if applicable)
  • Stop Gap or Employers Contingent Liability (if applicable)
  • Liquor Liability / Host Liquor Liability (if applicable)
  • Owned and Non-Owned Watercraft (if applicable)
Minimum limit of liability shall be $1,000,000 combined single limit bodily and property damage (CSL) each occurrence except:

2,000,000 CLS per occurrence
    • Where liability insurances is required by any section of the Whatcom County Fire Code
    • Inflatables
    • Animal Rides, Petting Zoos or other animal related activities with non-standard household pets
    • Liquor Sales
    • Motorized and/or power supported tool and equipment activities (including chainsaws)
    • Motorized individual participant activities (motorcycles, jet skis, model cars, boats and planes)
5,000,000 CLS per occurrence
    • Carnival type rides, trampolines and related rides and attractions commonly associated with a fair or carnival
Volunteers:  Commercial insurance provisions must be documented for all volunteers, with a minimum of $25,000 per person Medical/AD&D and personal liability with a minimum limit of $100,000 per person. Volunteers driving in the course of their activity must have current liability insurance that meets the State of Washington statutes. Permit holders are encouraged to require, or provide, excess liability insurance for their volunteer drivers.

Workers Compensation:  The permit holder shall secure its liability for industrial injury to its employees in accordance with the provision of Title 51 or the Revised Code of Washington. The permit holder shall be responsible for Workers Compensation Insurance for any subcontractor it may use or hire for the permit activity. 

Sporting Events, Runs and Races: Events that have runs, walks, races, sporting and athletic activities as part of their event will be required to have signed participant liability waivers. Required Liability Form Language. Copies of the waivers must be returned to the department as part of the permit process.
