A Conditional Use Permit is required for any use listed under the conditional use section in a given zoning designation. Conditional use permits are generally required for a variety of uses, including but not limited to, schools, churches, signs, mobile home parks, some commercial businesses etc.
Process
The process includes submittal of a
Conditional Use Permit Application (PDF) with appropriate fees to Planning and Development Services (PDS). PDS staff will then route the application to members of the Technical Review Committee including
Critical Areas, Plans Examiner,
Public Works, and
Fire Marshal’s Office and a Notice of Application will be sent to property owners within 300 or 1,000 feet.
Staff will then review the application with the Technical Review Committee requesting their comments and conditions of approval and either issue a request for more information or make a recommendation of approval or denial of the application to the Whatcom County Hearing Examiner.
A public hearing will be held with the Whatcom County Hearing Examiner and he will either approve or deny the application. After approval by the
Hearing Examiner the applicant may apply for building permits consistent with the conditions of approval for the conditional use.
