Electronic Deferred Finding
You do not have to come to court to request a deferred finding of your infraction ticket.
A deferred finding is an opportunity to have your infraction ticket dismissed and not reported to the Department of Licensing. You must submit your request for a deferred finding within thirty (30) days of the date you received the infraction.
You may qualify for a deferred finding if:
You have not had a deferred finding within the last seven (7) years.
You do not have a commercial driver’s license (CDL) in any State.
The infraction is not for:
Conditions of a deferred finding
If you meet both conditions, your ticket will be dismissed and it will not be reported to the Department of Licensing. However, if the infraction involves an accident, law enforcement separately reports the accident to the Department of Licensing.
If you do not comply with both conditions, the Court will find this infraction COMMITTED without further notice. If you fail to pay the administrative fee within 90 days, your deferred will be revoked and the Court will impose the entire original penalty stated on the Notice of Infraction. If you commit a new infraction within the deferral period, the court will impose the entire original penalty stated on the Notice of Infraction and the administrative fee that has been paid will be non-refundable. The Court may also assess an additional penalty and the Department of Licensing may suspend your driving privileges. You also waive your right to a speedy hearing, including your right under IRLJ 206. You are allowed only one deferral of a traffic infraction and one deferral of a non-traffic infraction in a seven (7) year period.
